Regulations on Administration of Scientific Research of Commercial Cipher Codes

Article 1 With a view to strengthening the scientific research administration and promoting the technical progress of commercial cipher codes, the Regulations is hereby formulated in accordance with Regulations on Administration of Commercial Cipher Codes.
Article 2 For the purposes of the Regulations, scientific research activities concerned with the system, protocol, algorithm and technical specification of commercial cipher codes apply; however, academic and theoretical researches do not apply.
Article 3 The State Cryptography Administration is responsible for the scientific research administration of commercial cipher codes throughout the country.
Article 4 The scientific research of commercial cipher codes is undertaken by the unit designated by the State Cryptography Administration (hereinafter referred to as designated scientific research unit of commercial cipher codes).
Article 5 The State Cryptography Administration designates the designated scientific research unit of commercial cipher codes based on the development and scientific research demands of commercial cipher codes.
The designated scientific research unit of commercial cipher codes must have independent legal person qualification, be provided with corresponding technical strength and equipment to be engaged in scientific research of cipher codes, can adopt advanced coding theory and technology, and compile commercial cryptographic algorithms with high confidentiality and anti-attack capability.
Article 6 The State Cryptography Administration shall regularly designate the designated scientific research unit of commercial cipher codes in a centralized manner in principle.
The designation procedure for designated scientific research unit of commercial cipher codes is as follows:
(I) the applicant unit fills in "Application Form for Designated Scientific Research Unit of Commercial Cipher Codes" and submits it to the State Cryptography Administration;
(II) the State Cryptography Administration conducts preliminary examination on the written material submitted by the applicant unit and gives preliminary examination opinion;
(III) the State Cryptography Administration conducts on-the-spot investigation for the unit passing the preliminary examination, and organize expert assessment where necessary;
(IV) the State Cryptography Administration makes the designation decision and informs the designation result.
Article 7 The State Cryptography Administration issues "Certificate for Designated Scientific Research Unit of Commercial Cipher Codes" to the designated scientific research unit of commercial cipher codes and promulgates it.
"Certificate for Designated Scientific Research Unit of Commercial Cipher Codes" is valid for 6 years.
The State Cryptography Administration shall conduct annual assessment for the designated scientific research unit of commercial cipher codes. If the unit fails to pass the above assessment, its qualification of designated scientific research unit of commercial cipher codes shall be revoked.
Article 8 If the designated scientific research unit of commercial cipher codes changes its name, it shall, within 30 days from the date of change, carry the certificate of change to transact change formalities of "Certificate for Designated Scientific Research Unit of Commercial Cipher Codes" at the State Cryptography Administration.
If the designated scientific research unit of commercial cipher codes changes its address or legal representative, it shall, within 30 days from the date of change, carry the certificate of change to put on records at the State Cryptography Administration.
The designated scientific research unit of commercial cipher codes shall, in case of any change in its affiliation, capital structure or scientific research capability of commercial cipher codes, report the change to the State Cryptography Administration. For the unit not suitable for further scientific research of commercial cipher codes, the State Cryptography Administration shall revoke its qualification of the designated scientific research unit.
