0 Introduction
The Rules was prepared based on the safety risks and certification risks of children vehicles, and it stipulates the basic principles and requirements for implementation of compulsory product certification for children vehicles.
Children vehicles shall not endanger the safety or health of any user or third party when used in a predetermined or predictable manner. When children vehicles are only used by children of a specific age, the abilities of the user and his/her guardian under appropriate circumstances shall be taken into account.
In order to meet the above basic safety requirements, the certification client shall ensure that the children vehicles entering the Chinese market can meet the certification standards, obtain the compulsory product certificate and be applied with CCC mark.
The Rules shall be used in conjunction with the general implementation rules issued by Certification and Accreditation Administration of the People's Republic of China (CNCA), such as Implementation rules for compulsory product certification - Classification, management, certification modes selection and determination for production enterprises, Implementation rules for compulsory product certification - Utilization of testing resources and other certification results of production enterprises, and Implementation rules for compulsory product certification - General requirements for factory inspection.
The certification body shall, in accordance with the requirements of general implementation rules and the Rules, prepare detailed rules for the implementation of certification, which shall be implemented together with the general implementation rules and the Rules.
1 Application scope
The Rules is applicable to children vehicles, including child bicycles, child tricycles, wheeled child conveyances and baby walking frames.
The specific application scope and the adjustment of application scope due to changes in laws and regulations or related product standards, technologies, industrial policies and other factors shall be subject to the announcement issued by the State Administration for Market Regulation (CNCA).
2 Certification standards
Child bicycles: GB 14746 Safety requirements for bicycles for young children;
Child tricycles: GB 14747 Safety requirements for child tricycles;
Wheeled child conveyances: GB 14748 Safety requirements for wheeled child conveyances;
Baby walking frames: GB 14749 Safety requirements for baby walking frames.
For the above standards, in principle, the latest editions issued by the national standardization administrative department shall apply. When other editions of the standards need to be used, they shall be implemented in accordance with the announcement issued by the CNCA on the requirements of relevant applicable standards.
3 Certification mode
The basic certification mode for implementing compulsory product certification for children vehicles is as follows:
Type test + enterprise quality assurance capacity and product consistency inspection (initial factory inspection) + post-certification supervision.
A small quantity of children vehicles delivered/imported in a single batch may be exempted from enterprise quality assurance capacity and product consistency inspection (initial factory inspection) and post-certification supervision, and the relevant requirements shall be specified by the certification body in the detailed rules for the implementation of certification for certification, with the specific quantity determined through negotiation between the certification body and the certification client.
The post-certification supervision above refers to the post-certification follow-up inspection, sampling testing or inspection on production site, market sampling testing or inspection, or their combinations.
The certification body shall implement classification management on production enterprises according to the requirements of the Implementation rules for compulsory product certification - Classification, management, certification modes selection and determination for production enterprises, and combine various post-certification supervision methods according to the results of classification management, so as to determine the applicable certification mode for the certification client.
4 Certification unit division
In principle, certification units shall be divided by main materials, load-bearing structure, etc. of children vehicles. The certification body shall specify specific requirements for the division of certification units in the detailed rules for the implementation of certification.
The same products produced by the same producer in different production enterprises, or the same products produced by different producers in the same production enterprise may be divided into the same certification unit.
5 Certification entrustment
5.1 Submission and acceptance of certification entrustment
The certification client shall propose certification entrustment in a proper manner to the certification body, which shall handle the entrustment and feed back to the certification client whether it accepts or rejects the entrustment within the time limit specified in the detailed rules for the implementation of certification.
The certification body shall not accept the entrustment not complying with the requirements of the national laws & regulations and relevant industrial policies.
5.2 Entrustment data
The certification body shall specify the list of entrustment data (at least including letter or contract of certification entrustment, or registration certificate of certification client/producer/production enterprise) in the detailed rules for the implementation of certification according to the requirements of laws, regulations and standards and as necessary for certification implementation.
When necessary, for production enterprises for which the enterprise quality assurance capacity and product consistency inspection is not required in certification, the certification body may request the certification client to submit a self-evaluation report on the factory quality assurance capacity and product consistency control of the production enterprise.
The certification client shall provide the necessary data in accordance with the list of entrustment data given in the detailed rules for the implementation of certification. The certification body is in charge of the review, management, preservation and confidentiality of relevant data, and shall inform the certification client of the result of review.
5.3 Implementation arrangements
The certification body shall reach an agreement with the certification client on their relevant responsibilities and arrangements in each link of implementing the certification, and determine the specific scheme for implementation of the certification and inform the certification client according to the actual situations and classification management of the production enterprises and the requirements of the Rules and the detailed rules for the implementation of certification.
6 Implementation of certification
6.1 Type test
The certification body shall specify specific requirements for type test in the detailed rules for the implementation of certification.
6.1.1 Type test plan
The certification body shall develop the type test plan after the data review, and notify it to the certification client.
The type test plan includes requirements, quantities, testing standard, testing items, etc. of all samples for the type test.
6.1.2 Requirements for type test samples
In the detailed rules for the implementation of certification, the certification body shall specify the relevant requirements for sampling/sample submission of products to be certified. Generally, the type test samples shall be determined according to the requirements of the type test plan or the detailed rules for the implementation of certification, and shall be submitted by the certification client; where necessary, the certification body may also obtain samples by on-site sampling/sealing.
The certification client shall ensure the consistency between the samples it provides and the actual products. The certification body/or the laboratory shall review the authenticity of the samples provided by the certification client. In case of any doubt about the authenticity of the samples, the laboratory shall explain the reasons to the certification body, and carry out corresponding treatment.
6.1.3 Type test items
The type test on children vehicles shall meet the requirements of relevant clauses in the certification standards.
6.1.4 Implementation of type test
The certification client may choose the laboratory designated by CNCA to complete the type test. The laboratory shall carry out type test on the samples, make a complete record on the whole test process, and keep it on file, so as to ensure the traceability of the records of the test process and results.
The certification client may carry out the type test prior to proposing certification entrustment to the certification body. The certification body shall specify the relevant requirements that the certification client implements the type test first in the detailed rules for the implementation of certification.
