0 Introduction
According to the relevant requirements of the “Decision of the State Council on adjusting the catalog of industrial products production license management to strengthen during- and post-event supervision” [GUOFA (2019) No.19], the management of brake lining products for automobiles has been changed from production license management to compulsory product certification management. The Rules is formulated in accordance with the provisions of laws and administrative regulations such as “Regulations of the People’s Republic of China on certification and accreditation” and “Provisions on the administration of compulsory product certification”.
The Rules is formulated based on the safety risks and certification risks of brake lining products for automobiles, and it stipulates the basic principles and requirements for implementation of compulsory product certification of brake linings for automobiles.
The Rules shall be used in conjunction with the general implementation rules issued by Certification and Accreditation Administration of the People's Republic of China (CNCA), such as “Rules for the implementation of compulsory product certification - Manufacturing enterprise classification management, certification mode selection and confirmation”, “Rules for the implementation of compulsory product certification - Utilization of testing resources and other certification results of manufacturing enterprise”, “Rules for the implementation of compulsory product certification - General requirements for factory inspection”, etc.
The certification body shall, in accordance with the requirements of general implementation rules and the Rules, prepare detailed rules for the implementation of certification, which shall be implemented together with the general implementation rules and the Rules.
The manufacturing enterprise shall ensure the continuous compliance of its certified products with the requirements of the certification and applicable standards.
1 Application scope
The Rules is applicable to brake linings for automobiles (hereinafter referred to as linings). Any adjustment to the application scope caused by any change in laws and regulations, related product standards, technologies, industrial polices and other factors shall be subject to the announcement issued by CNCA.
2 Certification standards
According to GB 5763-2008 “Brake linings for automobiles”.
The standards used for certification shall be the latest editions issued by the national competent administrative department of standardization. Any addition of applicable standards or use of other editions, where necessary, shall be subject to the relevant announcement specified by applicable standards issued by CNCA.
3 Certification mode
Basic certification mode for implementing compulsory certification of brake linings for automobiles is as follow:
Type test + initial factory inspection + post-certification supervision;
The mode of post-certification supervision refers to the combinations of post-certification follow-up inspection, sampling from the production site for testing/inspection and market sampling testing/inspection.
The certification body shall confirm the applicable certification mode of the manufacturing enterprises with different capacity and grade in accordance with the requirements of the “Rules for the implementation of compulsory product certification - Manufacturing enterprise classification management, certification mode selection and confirmation”.
4 Certification unit division
The certification client shall propose certification entrustment according to the unit, and the certification body shall issue the certification certificate according to the unit. Lining products that do not differ in the following main aspects can be classified into a unit:
(1) The applicable vehicle types of linings are divided into M1, M2, N1, O1 and O2 linings for automobiles and M3, N2, N3, O3 and O4 linings for automobiles;
(2) The types of brakes applicable to linings are divided into linings for drum brakes and linings for disc brakes;
(3) Structure and material of lining (where applicable). The same unit may contain products of multiple "models (or specifications)". The same model refers to the product having no effect on the standard compliance in design. For the same products of the same producer (manufacturer) but from different manufacturing enterprises (referring to products with the same production technique and the same key part/raw material supplier), or the same products of different producers (manufacturers) but from the same manufacturing enterprise, type test may only be conducted on the samples of one unit, and the products of other producers (manufacturers)/manufacturing enterprises shall be subject to conformity check by providing data. Based on the manufacturing enterprise classification management, the certification body may appropriately loosen the requirements of unit division for manufacturing enterprises with higher grade classification management.
5 Certification entrustment
5.1 Proposing and accepting & handling of certification entrustment
The certification client shall propose certification entrustment in a proper manner to the certification body, which shall handle the application and feed back to the certification client whether it accepts or rejects the application within the time limit specified in the rules for the implementation of certification.
The certification body shall not accept the entrustment where the national laws & regulations and relevant industrial policies are not met.
5.2 Application data
The certification body shall specify the certification entrustment data [at least including certification application form or contract, registration certificate of certification client/producer/manufacturing enterprise, “Description of brake lining products for automobiles” (Attachment 1), “Conformity of production control plan” (prepared in accordance with Attachment 2, and conformity of production, hereinafter referred to as CoP), etc.] in the detailed rules for the implementation of certification, according to the requirements of laws, regulations, standards and the need of certification implementation.
The certification client shall provide the necessary data as per the list of application data in the detailed rules for the implementation of certification. The certification body is in charge of the review, management, preservation and confidentiality of relevant data, and shall inform the certification client of the result of review.
5.3 Implementation arrangements
The certification body shall reach an agreement with the certification client on their relevant responsibilities and arrangements in each link of implementing the certification, and determine the specific scheme for implementation of the certification and inform the certification client according to the actual situations and classified management situations of the manufacturing enterprises and the requirements of the Rules and the detailed rules for the implementation of certification.
6 Certification implementation
6.1 Type test
6.1.1 Type test scheme
The certification body shall develop the type test scheme after the data review, and inform the certification client.
The certification client may select the laboratory among the designated ones of its own accord. The type test scheme includes requirements, quantities, testing standard items, laboratory information, etc. of all samples for the type test.
6.1.2 Requirements for type test sample
In the detailed rules for the implementation of certification, the certification body shall specify the relevant requirements for sample submission of products for certification. Generally, the certification client shall submit samples as required by the type test scheme of the certification body to the laboratory specified by the CNCA for testing; when necessary, the certification body may otherwise obtain samples by means of site sampling/sealed sample.
The certification client shall ensure the conformity between the sample it provides and the actual product. The certification body and/or laboratory shall check the authenticity of the sample provided by the certification client. In case of any doubt about the authenticity of the sample, the laboratory shall explain the reasons to the certification body, and carry out corresponding treatment.
The certification body shall, in accordance with the relevant required documents issued by CNCA, specify the adopted list of the key parts & raw materials in the detailed rules for the implementation of certification.
6.1.3 Type test items
The type test items are the applicable mandatory provisions of corresponding standards given in Article 2 of the Rules.
6.1.4 Implementation of type test
Type test shall be completed in the laboratory designated by CNCA. The laboratory shall carry out the type test on the sample, make a complete record on the whole test process, and keep it on file, so as to ensure the traceability of the records of the testing process and results.
In case of any rejected test item, if any, the test may be carried out again after rectification upon the analysis on causes of the rejection. Where re-test is required, the laboratory shall inform the certification body of test conditions and the certification body shall re-confirm the test scheme.
6.1.5 Type test report
The certification body shall specify a uniform format for the type test report.
At the end of the type test, the laboratory shall issue a type test report to the certification body and the certification client. The certification client shall ensure that it can provide a complete and valid type test report to the certification body and the law enforcement agency during the post-certification supervision.
