0 Introduction Detailed rules for implementation of compulsory product certification - Toys (hereinafter referred to as the Detailed Rules) is prepared in accordance with the requirements of documents such as Implementation rules for compulsory product certification - Toy (CNCA-C22-02: 2020) (hereinafter referred to as the Rules), Implementation rules for cancellation, suspension and revocation of compulsory product certificates, Supplementary provisions concerning ODM mode in the implementation rules for compulsory product certification, Implementation rules for compulsory product certification - Classification, management, certification modes selection and determination for production enterprises, Utilization of testing resources and other certification results of production enterprises, Implementation rules for compulsory product certification - Factory quality assurance capacity requirements, Implementation rules for compulsory product certification - General requirements for factory inspection and Submission, transmission and disclosure of implementation rules for compulsory product certification, and is used in conjunction with the Rules as a supporting document. Toys shall not endanger the safety or health of users or third parties when used in a predetermined or predictable manner. When toys are only used by children of a specific age, the abilities of the user and his/her guardian under appropriate circumstances shall be taken into account. In order to meet the above basic safety requirements, the applicant shall ensure that the toys entering the Chinese market can meet the certification criteria, obtain the compulsory product certificate and be applied with CCC mark. With a view to maintaining the validity of product certification, improving the product quality, serving the enterprises applying for certification, controlling the certification risk and clarifying the implementation requirements for certification, the Detailed Rules is developed and publicized by the Certification Center of Light Industry Council (hereinafter referred to as CCLC) in accordance with the Rules. 1 Application scope The Detailed Rules is applicable to electric toys, plastic toys, metal toys and vehicle toys designed or intended for children under 14 years old to play with. The specific application scope and the adjustment of application scope due to changes in laws and regulations or related product standards, technologies, industrial policies and other factors, shall be subject to the announcement issued by the State Administration for Market Regulation (CNCA). 2 Certification criteria GB 6675.1 Toys safety - Part 1: Basic code GB 6675.2 Safety of toys - Part 2: Mechanical and physical properties GB 6675.3 Safety of toys - Part 3: Flammability GB 6675.4 Safety of toys - Part 4: Migration of certain elements GB19865 Electric toys -Safety (applicable to electric toys and electric vehicle toys. Clause 20 "Radiation, toxicity and similar hazards" are exempt from testing, and shall be ensured by producers from design and selection of spare parts and raw materials, and it does not exempt producers from the responsibilities of Clause 20). For the above standards, in principle, the latest versions issued by the national standardization administrative department shall be implemented. When other versions of the standards need to be used, they shall be implemented in accordance with the announcement issued by the CNCA on the requirements of relevant applicable standards. 3 Certification mode 3.1 Certification mode Basic certification mode: type test + post-certification supervision; A small quantity of toys delivered/imported in a single batch may be exempted from post-certification supervision. Generally, a small quantity of toys delivered/imported in a single batch are those made from the same materials and under the same production conditions, provided with a unique batch code and delivered/imported in a single batch, with the signed sales contract signed while sales purpose, customers, product models and quantity determined. The applicant shall submit an application for certification to CCLC, and CCLC shall determine the specific implementation plan according to the actual situation. The post-certification supervision refers to the post-certification follow-up inspection, sampling from the production site for testing or inspection, market sampling testing or inspection, or their combinations. Note: upon the acceptance by CCLC on the information submitted by the applicant, where the enterprise is assessed as a high-risk enterprise for certification, or when it is necessary to carry out on-site verification, the quality assurance capability and product consistency of the factory may be inspected first, and sampling testing may be adopted for product testing. 3.2 Principle of production enterprise classification CCLC collects and sorts out various quality information related to certified products and their production enterprises, and classifies the production enterprises accordingly. The applicant, producer (manufacturer) and production enterprise shall cooperate with CCLC. CCLC classifies the production enterprises into four levels, i.e., A, B, C and D respectively, according to the risk level from low to high. 3.2.1 Classification basis The quality information based on which the production enterprises are classified covers the following aspects at least: (1) submission of application data; (2) result of post-certification supervised testing; (3) results of factory inspection (including initial factory inspection and post-certification follow-up inspection); (4) results of national sampling inspection, random inspection on CCC validity and random inspection by governments at all levels, and product recalls; (5) information such as judicial decision, complaint arbitration, consumer association release, media exposure and law enforcement investigation related to certified/certificated products and enterprises; (6) other information. 3.2.2 Classification principle Class Classification conditions A Enterprises satisfying all of the following conditions may be evaluated as Class A if they: (1) are able to provide complete and clear application data according to the requirements of the Rules; (2) have no failure in post-certification supervised testing within the recent year; (3) have no major nonconformities in the initial factory inspection and the post-certification follow-up inspection within the recent year. Generally, for each inspection, there is no more than one nonconformity, and the use management and consistency control of the mark and certificate of the factory quality assurance capability; (4) have passed the national sampling inspection, random inspection on CCC validity and random inspection by governments at all levels within the recent two years; (5) have no judicial decision, complaint arbitration, consumer association release, media exposure and law enforcement investigation related to certified/certificated products and enterprises; (6) have the ownership over the main product processing procedures (such as plastic molding procedure for plastic toys and metal processing procedure for metal toys). If the subcontractor has passed the extended inspection by the center, this clause may be appropriately relaxed; (7) may be adjusted to Class A as evaluated by CCLC. B Other production enterprises except those of Classes A, C and D or those without any quality information. C Enterprises satisfying any of the following conditions may be evaluated as Class C if they: (1) provide application data with many problems, which need to be supplemented and improved for many times; (2) have certain problems in product quality or enterprise management, which shall be solved by themselves; however, such problems do not involve the certificate suspension and revocation; (3) have any major nonconformity or any nonconformity of which the rectification shall be verified on site, in each factory inspection within half a year; (4) shall be adjusted to Class C as evaluated by CCLC due to other reasons. D Enterprises satisfying any of the following conditions may be evaluated as Class D if they: (1) provide false application data and testing samples; (2) fail in the supervised sampling testing; (3) fail in any factory inspection within half a year or have their certificates suspended or revoked by the center due to many problems; (4) refuse the inspection or supervised/non-routine sampling without justified reasons; (5) fail in the national sampling inspection, random inspection on CCC validity and random inspection by governments at all levels, or have any product recalled (any inconformity with the certification standards) due to their own reasons; (6) have their certificates suspended or revoked by the center due to any judicial decision, complaint arbitration, consumer association release, media exposure and law enforcement investigation related to certified/certificated products and enterprises; (7) have any severe defect in product quality due to their own reasons, which may result in certificate suspension or revocation; (8) shall be adjusted to Class D as evaluated by CCLC due to other reasons. Before the annual follow-up inspection, CCLC will inform the production enterprises of the information on classification management determination/adjustment. CCLC implements dynamic management on production enterprises according to various relevant information collected in combination with classification principles and relevant requirements, and reevaluates and adjusts the classification results either regularly or irregularly. If an enterprise has any major problems affecting the result of risk assessment, it will be classified into the high-risk category by CCLC at any time according to the assessment result. On the contrary, if the evidence suggests that the factors causing the risks have been effectively controlled, CCLC usually adjusts the risk to low level successively in the order of D→C→B→A according to the risk assessment. If the production enterprise has sufficient reasons to prove that the reason of the downgrade is incidental and the production enterprise is always Class A before downgrade, CCLC may consider cross-class adjustment upon evaluation. 4 Certification unit division In principle, certification units shall be divided by main material, structure, function, predetermined play style, applicable age, etc. of toys. See Annex 1 Principles for compulsory certification unit division of toys for details. The certification unit division method of various products in Annex 1 is intended for general purpose. Considering the differences in the use functions, structures and specifications of products, it may be appropriately adjusted to reduce the risk of type test. The same products produced by the same producer in different production enterprises, or those produced by different producers of the same production enterprise may be divided into the same certification unit or deferent certification units. GB 6675.2《玩具安全 第 2 部分:机械与物理性能》; GB 6675.3《玩具安全 第 3 部分:易燃性能》; GB 6675.4《玩具安全 第 4 部分:特定元素的迁移》; GB 19865《电玩具的安全》(适用于电玩具、带电的乘骑车辆玩具,其中 第 20 章“辐射、毒性和类似危害”免于检测,由生产者负责从设计和选取零部 件、原材料等方面予以保证,不免除生产者对第 20 章的责任)。 上述标准原则上应执行国家标准化行政主管部门发布的最新版本。当需使用 标准的其他版本时,则应按照认监委发布的适用相关标准要求的公告执行。 3 认证模式 3.1 认证模式 基本认证模式为:型式试验 + 获证后监督; 对于少量的单批次出厂/进口玩具,可免于获证后监督。少量单批次出厂/ 进口玩具通常认为是已签订了销售合同并确定了销售目的、客户、产品型号和数 量,使用相同物料、在同一生产条件下,产品上标识有唯一批次代码,一次性出 厂/进口的少量玩具。认证委托人需向 CCLC 提出认证申请,CCLC 根据实际情况 确定具体实施方案。 获证后监督是指获证后的跟踪检查、生产现场抽取样品检测或者检查、市场 抽样检测或者检查三种方式之一或组合。 注:CCLC 对认证委托人提交的资料进行认证受理时,经评估为认证高风险 企业,或有必要实施现场核实时,可先行实施工厂质量保证能力和产品一致性的 检查,并可采取抽样检测方式进行产品检测。 3.2 生产企业分类原则 CCLC 收集、整理与认证产品及其生产企业有关的各类质量信息,并据此对生 产企业进行分级。认证委托人、生产者(制造商)、生产企业应予以配合。 CCLC 将生产企业按照风险等级由低到高分为四级,分别用 A、B、C、D 表示。 3.2.1 分级依据 生产企业分级所依据的质量信息至少包含如下方面: (1)申请资料的提交情况; (2)证后监督检测结果; (3)工厂检查结果(含初始工厂检查、获证后跟踪检查); (4)国抽、CCC 有效性抽查、各级政府抽查检测结果、产品召回情况; (5)与认证/获证产品及企业有关的司法判决、申投诉仲裁、消费者协会发 布、媒体曝光、执法查处等信息; (6)其他信息。 3.2.2 分级原则 级别 分级条件 A 满足以下所有条件可评价为 A 级: (1)能够按实施规则的要求完整、清晰地提供申请资料; (2)近 1 年内证后监督检测未出现不合格; (3)近 1 年内的初始工厂检查和获证后跟踪检查未发现严重不符 合项。每次检查一般不符合项不超过 1 个并且不含工厂质量保证能 力中标志和证书使用管理、一致性控制内容; (4)近 2 年内国抽、CCC 有效性抽查、各级政府抽查检测结果均为 合格,不存在产品召回情况; (5)未出现过与认证/获证产品及企业有关的司法判决、申投诉仲 裁、消费者协会发布、媒体曝光、执法查处; (6)产品主体加工工序(例如塑胶材质玩具的塑料成型工序、金 属材质玩具的金属加工工序)为企业自有。如分包方已通过中心延 伸检查,此条款可适当放宽; (7)经 CCLC 评价可以调整为 A 级的。 B 除 A 级、C 级、D 级的其他生产企业或没有任何质量信息的生产企 业。 C 满足以下条件之一的,可评价为 C 级企业: (1)提供的申请资料存在较多问题,需多次补充和改进; (2)产品质量或企业管理存在一定问题且系企业责任,但不涉及 暂停、撤销认证证书的; (3)半年内任一次工厂检查存在严重不符合项或不符合项整改验 证方式为“现场验证”; (4)由于其他原因经 CCLC 评价认为需调整为 C 级的。 级别 分级条件 满足以下条件之一的,可评价为 D 级企业: (1)提供虚假申请资料及检测样品; (2)监督抽样检测结果为不合格; (3)半年内任一次工厂检查结论判定为“不通过”或存在问题较 多被中心暂停、撤销证书; (4)无正当理由拒绝检查或监督/非例行抽样的; D (5)出现国抽、CCC 专项抽查、各级政府抽查检测结果不合格、产 品召回(不符合认证标准要求)系企业责任; (6)出现过与认证/获证产品及企业有关的司法判决、申投诉仲裁、 消费者协会发布、媒体曝光、执法查处被中心暂停、撤销证书; (7)产品质量存在严重问题且系企业责任,可直接暂停、撤销认 证证书的; (8)由于其他原因经 CCLC 评价认为需调整为 D 级的。 CCLC 将在年度跟踪检查前,将生产企业分类管理等级确定/调整的信息告知 生产企业。CCLC 依据收集的各类相关信息,结合分类原则和相关规定对生产企 业实施动态化管理,定期或不定期对分类结果进行再评价和分类调整。当生产企 业出现影响风险评估结果的重大问题时,CCLC 将随时根据评价结果将该生产企 业划为高风险类别。反之,如有证据说明导致风险的要素已得到有效控制,CCLC 将根据风险评价情况按照 D→C→B→A 的顺序逐次向低风险类别调整。 4 认证单元划分 原则上,应按玩具主要材质、结构、功能及预定玩耍方式、适用年龄等的不 同划分认证单元。 认证单元划分原则具体见附件 1《玩具产品认证单元划分原则》。附件 1 中 各类产品的认证单元划分方法为通用性的划分方法,实施中因产品的使用功能、 产品结构、规格的差异等因素,可能会做适当调整,以减少型式试验的风险。 相同生产者、不同生产企业生产的相同产品,或不同生产者、相同生产企业 生产的相同产品,可划分为同一认证单元,也可划分为不同单元。认证委托人如 拟划分为同一认证单元在申请时向 CCLC 另行提出要求及说明,CCLC 根据实际情 况判定是否受理,如可以受理由 CCLC 确定具体实施方案。 5 认证委托 5.1 认证委托的提出 认证委托人通过在线申请认证平台(app.cclc.cn)向 CCLC 提出认证申请, 需按相关要求准确的填写认证委托人、生产者、生产企业和产品等必要的信息, 并提交以下申请及技术资料: (1)强制性产品认证申请书; (2)强制性产品认证协议书; (3)强制性产品认证符合性声明; (4)认证委托人、生产者、生产企业的注册证明文件(如营业执照等); (5)企业概况调查表; (6)生产企业的关键生产设备清单、主要检测仪器设备清单; (7)生产企业质量管理文件清单; (8)产品有关信息 产品类别 产品有关信息内容 电玩具 主体材料的通用名称(如金属材料、塑胶材料、布绒材料等, 塑胶材质可分为 ABS、PS、PP 等);玩具的结构、外形尺寸; 功能、预定玩耍方式、控制方式(如线控、按键开关控制等); 电源类型(电池(电池种类应注明)供电、适配器供电、双 电源供电);适用年龄组。 塑胶玩具 主体材料的通用名称(如 ABS、PP、PVC 等);功能、预定 玩耍方式;玩具的结构、外形尺寸;适用年龄组。 金属玩具 主体材料的通用名称(如马口铁、锌合金、铝合金等);功 能、预定的玩耍方式;适用年龄组;玩具的结构、外形尺寸)。 乘骑车辆玩具 主体材料的通用名称(如金属材料、塑胶材料、木质材料等, 塑胶材质可分为 ABS、PS、PP 等);功能、预定玩耍方式; 玩具的结构、外形尺寸;制动装置;适用年龄组。 (9)关键原/辅材料、零部件清单 清单中应说明其名称、型号、规格、生产企业。主要包括: (10)足以识别所有认证产品主要特性的照片或图片及必要的文字; (11)认证委托人、生产者、生产企业之间签订的有关协议书或合同(如 ODM/OEM 协议); (12)认证委托人委托他人办理认证时,应当与受委托人订立有关认证、检 测、检查和监督等事项的委托书或合同。申请认证时,受委托人应当同时向指定 认证机构提交所签订的委托书或合同副本; (13)对于变更申请,相关变更项目的证明文件; (14)对于少量的单批次出厂/进口玩具,认证委托人需提供该批次产品的 生产合同等能够证明唯一批次的文件。认证委托人需在产品本体或最小独立包装 上标注该批次产品可识别代码,要与申请批次对应,并提供照片示例; (15)必要时提供承诺书,包括但不限于少量的单批次出厂/进口玩具认证、 使用企业标准、认证标准不能完全覆盖申请产品等; (16)必要时,对认证实施中未涉及企业质量保证能力和产品一致性检查的 生产企业,CCLC 可要求认证委托人提交生产企业有关工厂质量保证能力和产品 一致性控制的自我评估报告; (17)其他需要的文件。 认证委托人应对提供资料的真实性负责。 CCLC 对认证委托人提供的认证资料进行管理、保存,并负有保密的义务。 5.2 认证委托的受理及实施安排 CCLC 依据相关要求对认证申请资料进行审核,在 5 个工作日内发出受理或 不予受理的通知,或要求认证委托人整改后重新提出认证申请。受理通知中通常 包括以下内容: (1)所受理的具体认证产品单元、规格型号; (2)有关 CCLC 工作人员的联系方式; (3)其他需要说明的事项。 不符合国家法律法规及相关产业政策要求时,CCLC 不受理相关认证委托。 6 认证实施 6.1 型式试验 6.1.1 型式试验方案 CCLC 在受理认证申请后,制定型式试验方案,并告知认证委托人。型式试验 方案包括:样品要求和数量、检测标准及项目、实验室信息等。 6.1.2 型式试验样品要求 通常情况下,型式试验的样品由认证委托人按 CCLC 的要求寄送代表性样品 用于检测。必要时,CCLC 也可采取现场抽样/封样方式获得样品。 认证委托人应保证其所提供的样品与实际生产产品的一致性。CCLC 和/或实 验室应对认证委托人提供样品的真实性进行审查。实验室对样品真实性有疑义 的,应当向 CCLC 说明情况。应经核查确认后做出相应处理。 一般情况下,每一认证单元均应寄送样品进行型式试验,必要时进行差异检 测。 一般情况下,同一认证单元主检样品数量为: 产品类别 主检样品送样/抽样数量(个) 电玩具 4 塑胶玩具 4 金属玩具 4 乘骑车辆玩具 2 每个需做差异检测的样品数量为: 产品类别 差异样品送样/抽样数量(个) 电玩具 1-2 塑胶玩具 1-2 金属玩具 1-2 乘骑车辆玩具 1 注:如遇特殊情况需要增加或减少样品数量,由认证委托人、实验室和 CCLC 协商确定。 6.1.3 型式试验检测项目 (1)GB 6675.1《玩具安全 第 1 部分:基本规范》; (2)GB 6675.2《玩具安全 第 2 部分:机械与物理性能》; (3)GB 6675.3《玩具安全 第 3 部分:易燃性能》; (4)GB 6675.4《玩具安全 第 4 部分:特定元素的迁移》; (5)GB 19865《电玩具的安全》(适用于电玩具、带电的乘骑车辆玩具, 其中第 20 章“辐射、毒性和类似危害”免于检测,由生产者负责从设计和选取 零部件、原材料等方面予以保证,不免除生产者对第 20 章的责任)(适用时) 原则上应包括产品安全标准规定的全部适用项目。 当对标准中部分检测项目有所调整时,则按认监委发布的相关规定文件执 行。 6.1.4 型式试验的实施 认证委托人可自行选择国家认监委指定的 CCLC 签约的实验室完成型式试 验。实验室对样品进行型式试验,并对检测全过程做出完整记录并归档留存,以 保证检测过程和结果的记录具有可追溯性。 产品检测时间自样品送达实验室之日起计算,电玩具、塑胶玩具、金属玩具 的检测周期为 15 个工作日,乘骑车辆玩具的检测周期为 20 个工作日,不包括样 品整改时间。 型式试验检测若发生不合格,应在限期内整改,最长整改时限不超过 3 个月。 如期完成整改后,认证委托人应重新送样至原承检实验室复检。逾期不能完成整 改,或整改结果不合格,实验室出具产品不合格检测报告,连同产品整改过程中 的有关信息报 CCLC,CCLC 做出终止认证的决定。 型式试验完成后,主检样品由实验室封存至少 1 年,也可实验室加贴封条后 由生产企业封存至少 1 年,其它样品按认证委托人要求处置。 认证委托人也可先行在国家认监委指定的实验室实施型式试验,再向 CCLC 提出认证委托。CCLC 对型式试验报告内容进行评价,如发现检测样品或检测项 目不能满足认证要求,可重新安排型式试验或补充检测。 6.1.5 型式试验报告 型式试验报告格式需采用 CCLC 规定的报告格式。 型式试验结束后,实验室应及时向认证委托人、CCLC 出具型式试验报告。型 式试验报告应包含对认证单元内所有产品必要信息的描述。认证委托人应确保在 获证后监督时能够向 CCLC 和执法机构提供完整有效的型式试验报告。 6.2 认证评价和决定 CCLC 对型式试验结论、企业质量保证能力和产品一致性检查结论(适用时) 和有关资料/信息进行综合评价,做出认证决定。对符合认证要求的,颁发认证 证书。对不符合认证要求的,不予批准认证。 6.3 认证时限 认证委托人须对认证活动予以积极配合。认证受理时限见本细则 5.2 条款, 型式试验时限见本细则 6.1.4 条款。一般情况下,自受理认证委托起 90 天内向 认证委托人出具认证证书,认证委托人送样、型式试验整改、工厂检查不合格整 改等时间不计算在内。CCLC 确保相关工作按时限要求完成。
